Colours displayed on screen may differ from the final printed product due to differences in screen calibration, device settings, and the nature of digital printing processes.

Slight variations in print placement, sizing, and shade are inherent to the print-on-demand production process and do not constitute defects unless the variation is material and significantly different from the product described or depicted.

Product appearance may vary depending on the type of device you use to access the store and your device display settings.
We do not warrant that the appearance or quality of any products will precisely match digital representations. However, we do warrant that our products will correspond to their written description in all material respects. If your product arrives in a condition that is materially different from its description, please refer to our Refund Policy [LINK].
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. HaythereHorseArt.com reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until HaythereHorseArt.com confirms acceptance in writing. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting. As our products are print-on-demand, we may be unable to accommodate cancellation requests once production has commenced. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made, and a full refund will be issued promptly.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK]. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 — PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be confirmed in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.
All prices are displayed in US Dollars (USD). As we are a UK-based business selling internationally, currency conversion rates and any associated banking fees applied by your payment provider are beyond our control and are your responsibility.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are duly authorised to use such payment method; (iii) charges incurred by you will be honoured by your payment provider; and (iv) you will pay charges incurred by you at the posted prices, including shipping, handling charges, and all applicable taxes.
SECTION 5 — SHIPPING, DELIVERY AND ORDER DELAYS
All delivery timeframes provided at checkout are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our reasonable control.
As we sell print-on-demand products, fulfilment times may be affected by production schedules or carrier delays. In the event that your order cannot be shipped within the advertised timeframe (or within 30 days if no specific timeframe is stated, in accordance with the FTC Mail, Internet, or Telephone Order Merchandise Rule):

We will notify you by email with a revised estimated shipping date as soon as reasonably practicable.

You will be given the option to consent to the delay or to cancel your order for a full refund.

If we do not receive your consent to the delay within a reasonable time, your order will be cancelled and a full refund issued within 7 working days.
We will make reasonable efforts to assist you in the event of a shipping carrier dispute or loss in transit; however, once goods have been handed to the carrier, responsibility for delivery rests with the carrier. We recommend retaining your tracking information. Please contact us if your order does not arrive within the estimated delivery window and we will investigate on your behalf.
SECTION 6 — INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product designs, video, and audio, and the design, selection, and arrangement thereof, are owned by HaythereHorseArt.com, its affiliates or licensors and are protected by UK, US and international copyright, trademark and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on the Services without our prior written consent.

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have any control over. We provide access to such tools "as is" and "as available" without any warranties of any kind. Any use of optional third-party tools is entirely at your own risk and discretion.

If you decide to leave the Services to access third-party sites, you do so at your own risk. SECTION 9 — RELATIONSHIP WITH SHOPIFY
HaythereHorseArt.com is powered by Shopify, which provides the platform enabling us to deliver the Services to you. However, all sales and purchases you make are made directly with HaythereHorseArt.com. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and HaythereHorseArt.com, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with HaythereHorseArt.com.

HaythereHorseArt.com warrants that our products will materially correspond to their written descriptions at the time of sale. This limited written warranty does not affect your statutory rights as a consumer under applicable law.
EXCEPT FOR THE LIMITED WARRANTY STATED ABOVE, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY FURTHER REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
Important: Some US states and other jurisdictions do not allow the exclusion or limitation of implied warranties in consumer contracts. TO THE FULLEST EXTENT PROVIDED BY APPLICABLE LAW, IN NO CASE SHALL HaythereHorseArt.com, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE.
Important: Several US states — including New Jersey, Massachusetts, and others — do not permit the limitation of consequential or incidental damages in consumer contracts. In those states, the above limitation may not apply to you in full or in part. Additionally, nothing in this section limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability that cannot be excluded or limited under applicable law.
SECTION 17 — INDEMNIFICATION
You agree to indemnify, defend and hold harmless HaythereHorseArt.com, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising out of: (1) your breach of these Terms of Service; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim. We may control the defence and settlement of such claim at your expense, but will not settle any claim requiring non-monetary obligations from you without your consent.
SECTION 18 — DISPUTE RESOLUTION
We hope to resolve any concerns you have quickly and fairly. If you have a complaint or dispute relating to your order or these Terms, we ask that you first contact us directly at info@haytherehorseArt.com to allow us the opportunity to resolve the matter informally before taking any formal legal action.
We aim to acknowledge all complaints within 2 business days and to reach a resolution within 14 business days. If we are unable to resolve your complaint informally, either party may pursue their legal remedies in accordance with Section 21 (Governing Law) below.
Nothing in this section prevents you from exercising any statutory rights available to you under applicable consumer protection law, including the right to seek resolution through your state's consumer protection authority or through your payment provider's dispute resolution process.
SECTION 19 — SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 20 — WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written.
SECTION 21 — ASSIGNMENT
You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
SECTION 22 — GOVERNING LAW AND JURISDICTION
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. We are a business registered and operating in the United Kingdom.
Important notice for US customers: Notwithstanding the governing law clause above, if you are a consumer residing in the United States, you retain all rights afforded to you under applicable US federal consumer protection law (including FTC regulations) and the consumer protection laws of your state of residence. Those rights cannot be excluded or overridden by this agreement. Nothing in this section is intended to deprive you of any mandatory consumer rights available to you under US law.
In the event of a dispute that cannot be resolved informally (see Section 18), both parties agree to first attempt resolution through the dispute resolution process described in Section 18 before initiating formal legal proceedings.
SECTION 23 — HEADINGS
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 24 — CHANGES TO TERMS OF SERVICE
We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes. You can review the most current version of these Terms at any time on this page.
